Legislators Open the Door For Engineering Malpractice in Texas!

 Engineering Malpractice in Texas concerning Red Light Cameras should come as no surpise to the politicians who voted to keep them. With virtually no oversite installed in the Bill thats exactly what we have in Texas, NO OVERSITE!. Texas Camera Fraud did some Investigating.

     Lets use Arlington Texas results as an example. They Submitted data for 14 red Light Camera Intersections in 2009 to the Texas DOT. With only a 5 minute investigation of the reports, we found that  8 of the reports had missing data which is used to calculate Red and Yellow Light Timing. On the surface it could be chocked up to an honest mistake, but when you look at the collision and injury rates at intersections missing key engineering information you will find 3  intersections with the highest crash rates in this group. The main componants needed to establish correct engineering guidelines for traffic signals are Volume,  Speed, Distance Through Intersection, and Time. When you are missing these key engineering componants it is mathematically impossible to calculate and design these devices to work properly. If the reason we have these devices is for safety, then why are we not doing the neccessary work needed to make sure they are working properly. Secondly why is the Texas DOT Ignoring incomplete Data submitted from Texas Cities concerning Red Light Camera Enforcement? 

     Safety Safety Safety is all they say! When it comes right down to it there doesnt seem to be honest effort going into this endeavor from the cities. They use the safety aspect to sell Texans the idea of Red Light Cameras, but once they have the systems in place and the money starts flowing in they forget about the safety aspect. Dallas, Houston, Lubbock, College Station,  and City after City in Texas have Reported Engineering Flaws in the Red Light Data Accumulation Processes. If they recieved a grade for the papers they submitted at best they would get a 42. Colleges in Texas require you to maintain at least a 2.0 GPA and most Schools consider 70 a passing grade. Our grade to the City of Arlington is a Failing Grade! This Failure is not the cities alone to bear! Legislators in Texas established virtually no oversite guidelines and extremely poor engineering techniques to sell this product to the people of Texas. Our opinion is if you cant figure out how to use engineering formulas from the first semester of an accredited engineering degree program you have no right holding an engineering license in the State of Texas. If anyone who works for the State of Texas or Texas DOT reads this please feel free to use Time/ Speed/ Distance/ and Volume, as recommended by the Federal Highway Administration, in your equations. Who Knows you may actually save someones life!


Texas Legislators and Texas Cities Undermine the Federal Highway Administration Regulations!

Those white lines you see at Red Light camera Intersections are not the actual legal definition of the intersection according to the Federal Highway Administration. The FHA says cities must adhere to the MUTDC section 3A.02 which states the legal definition of the intersection is the prolongation of the lateral curb lines where the two streets meet. They conclude it is unlikely that drivers from another city or state would understand the meaning of the lines, and because there is no legal definition of a violation line at intersections in the MUTDC,  it gives them no basis for any legal measures.  The violation lines cities use to write red light camera tickets does not comply with the MUTDC. Texas Cities have made up thier own rules and have undermined the FHA. Basically this is a ficticious white line the Red Light Camera Companies have talked the Cities into using to increase ticketing in Texas, and export law enforcement, Texas cities are currently in violation of the MUTDC and Federal Highway Administration Regulations .

Texas Police Chief Fired for Questioning Red Light Cameras

Questioning the wisdom of photo enforcement can be fatal to the career of a top law enforcement official. Former Texas police Chief Michael Clancey found this out the hard way when he dared to suggest that the College Station City Council should not use red light cameras as a budgetary tool. Clancey filed a lawsuit in federal court last month demanding punitive damages and back wages from the city which, he claimed, violated his First Amendment rights. This is yet another attempt by city governments to reject US and Texas constitutional rights in thier quest to self govern themselves. Thier actions lean more towards a communist government approach than an elected democratic form of government.

More Fraud in Texas!

  A number of Texas cities are exploiting short yellow timing at intersections, generating significant additional revenue, according to a review of Texas Department of Transportation. The citation issuance rate at the nine intersections with the shortest yellow timing in the state was four times greater than the ticket issuance rate at locations that offered yellow times exceeding statewide averages. This seemingly minor difference resulted in a 132 percent increase in the number of citations issued for every 10,000 vehicles entering into the intersection compared to the locations with longer yellow durations. This increases the risk of being rear-ended. This is the tactic promoted by the Texas Department of Transportation who is in charge of “keeping our roads and highways safe”.

Corporate Cameras are taking over law enforcement!

A boom is taking place across Texas under the disguise of improving public safety. Red light cameras mark the first step in the agenda of “nationalized enforcement” of laws in Texas” Future plans by Corporations, Texas Cities, and State Government are to install Speed Cameras, Parking Meter Ticket Cameras, Parking Lot Ticket Cameras, Vehicular GPS Tracking Devices recording Speeds, Travel Desitinations, and Records of Travel, and will be followed up with the eventual issuance of fines for various other traffic violations caught on camera and digital information records. Insured vehicle checks will be done automatically along with monitoring of library fines. This agenda is already taking place in other cities being converted to Corporate Law Enforcement. Did the Texas Senators have any idea what they were doing when they didnt vote to ban the cameras in 2009? Here are some links to what the same Corporations are doing in other places. Duncanville Texas! A Lesson in a Communistic approach to problem solving!

Mayor David Green had Duncanville city counselman Paul Ford arrested for discussing Red Light Camera agendas and disrupting a meeting on his personal authority. According to the bylaws a counsel member can only be removed by a vote of the other counsel members present. Mr. Green had no right to have anyone removed from any counsel meeting without a vote being taken. Under Roberts Rules of Order  a mayor would first have issued a warning to an unruly member and, if ignored, put the question of what to do about it to the entire city council. A majority vote would be required to have a sitting member removed from the chambers after that member is given an opportunity to speak in his own defense. Under Duncanville’s city charter (2.15), only the full council can change the rules of procedure, not the mayor acting alone. So much for the democratic process and by laws. Even a citizen voicing thier opinion can only be removed by a vote. Mr. Ford was discussing Red Light Camera complaints he recieved from the voters who elected him. Mr Green seems to be under the belief he has more authority than he actually does. Watch the video’s and judge for yourself. This arrest was premeditated and used to teach a lesson to everyone who believes in Freedom of Speech, Democracy and Constitutional Rights. Notice that the Police Chief was positioned close to Mr. Ford and walks toward him prior to the mayor asking him to leave or be arrested! The arrest was planned! Amazingly enough the first words out of Mr. Greens mouth were: I didnt plan on having Mr. Ford Arrested! Sounds like a child caught with his hands in the cookie jar!

Nationalization of Law Enforcement in Texas is in progress! See How they do it!

   Red Light Cameras are a disease in Texas that needs to be stopped. Nationalization of Law Enforcement using Red light Camera Corporations as a mask are spreading like wildfire in Texas. Violations of our Constitional rights, Breaking of Federal laws, Violations of State business laws, unethical and immoral engineering practices are common in Texas today. Here is a list of Violations Texas Representatives, Senators, the Texas Attorney General, and the Texas Governor are allowing to take place with little regard to the voters rights in our state. They have allowed mayors and city counsels to over rule the Supreme Court of the United States, and the Supreme Court of Texas.

1. Texas Constitution bill of rights Sec. 15. RIGHT OF TRIAL BY JURY. The right of trial by jury shall remain inviolate. Texas City Counsels have overuled this law with wording in ordinances Defacing the United States Constitution and the Texas Constitution and declaring thier right to self govern without accountability in regards to Constitutional rights.

2. Texas Constitution Bill of Rights Sec. 28 SUSPENSION OF LAWS. No power of suspending laws in this State shall be exercised except by the Legislature. Texas City Counsels install a disclaimer in thier ordinances to make this law null and void.

3. U.S. Constitution 4th amendment rights – Search and arrest should be limited in scope according to specific information supplied to the issuing court by a law enforcement officer, who has sworn by it. In 2003 Texas Legislators voted to overule this law and allow unqualified private citizens and corporations to enforce law in the State of Texas. Warnings from the White House Staff, and R-Dick Armey concerning abuses in other countries by the same international corporations we are using in Texas were ingnored!

4. U.S. Constitution 5th amendment rights – no person shall be compelled in any criminal case to be witness against himself. Courts in Texas are trained by corporations to decieve people into testifying against themselves for Corporate and Private monetary gain.

5. US Constitution 6th amendment rights- The defense must have an opportunity to “confront” and cross examine witnesses. In Sept 2009 the Supreme Court of the United States upheld this right, but Cities in Texas are allowed to ignore it by the justification of rights to self govern themselves.

6. US Constitutional 14th amendment rights – The Court has ruled that in certain circumstances, the Due Process Clause requires a judge to recuse himself on account of concern of there being a conflict of interest. This law was overturned by Texas State legislators in 2003 by a unexplained rider on a trucking bill that was suppose to allow cities to change a moving violation to an ordinance violation to help the trucking industry by lowering insurance costs. To date Not one single moving violation anywhere in the State of Texas has been changed to a ordinance violation, but it has allowed the formation of Red Light Camera Corporations and Texas Cities to form business associations in the State of Texas taking away our independance and sovereignty.

7. Texas Courts Find Guilt By Omission and shift the burden of proof to the accused. Guilty untill proven innocent is the new status quo in Texas.

8. Promoting private corporations to defy the Texas Fair Debt Collection Practices Act § 392.304. By supplying FRAUDULENT, DECEPTIVE, OR MISLEADING REPRESENTATIONS and STATISTICS. This law is being ignored by corporations the State of Texas has allowed to sign contracts with the cities to enforce laws in our State for Corporate, Private, and Government monetary gain.

9. The State of Texas and City Counsels are promoting Privitization of our police force to corporations and exporting Texas law enforcement jobs to other Regions such as Ohio, Arizona, and Australia in tough economic times.Texas Legislators and city counsels have declined to preserve the balance between the rights of individuals and the need for effective law enforcement by keeping the enforcement of our laws in the hands of our trained law enforcement officers 0f Texas.

10. Promoting threats of false debt disclosure to credit reporting agencies through Red light camera program associations. Texas Legislators are allowing private corporations to destroy voters credit for non compliance of constitutional rights violations. People who refuse to give up thier US and Texas Constitutional rights will be punished.

11. Promoting threats of Illegal seizure of vehicles through associations with Red light camera companies and using the Texas Department of Transportation as a pawn in a clearly illegal extortion scheme. Non compliance of giving up constitutional rights will result in illegal vehicle and property seizure in 2010.

12. Violation of Deprivation of Rights Under Color of Law= Title 18, U.S.C., Section 242
This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S. Texas Legislators allow cities utilizing private corporations under the disguise of self governance violate this law.

13. Violation of Conspiracy against rights- Title 18, U.S.C., Section 241
This statute makes it unlawful for two or more persons to conspire to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States. Corporations, State Government, and Cities who engaged in collective business activity concerning Red Light Cameras in Texas. Violate this law.

14. Falsification of Engineering studies, Violating Federal Highway Administration Regulations, Deceptive Texas DOT Standards and Statistics, and Engineering Malpractice are being utilized daily in the State of Texas by corporations to extort money from the general populations. Texas legislators allow this behavior to continue to make money for Texas Cities and the State of Texas.
